These Terms & Conditions apply to all works carried out by Bayside Plumbing & Gas Solutions and Drain Rat (the Contractor).
All works carried out by fully licensed and insured tradesman.
For large jobs a deposit may be required to cover cost of materials and progress payments needed on continuing jobs.
Works may be quoted on either:
(a) a fixed rate (flat rate) basis; or
(b) a time and materials (charge-up) basis at hourly rates plus materials, equipment & GST.
Where works are undertaken on a charge up basis, labour, materials, equipment and sundries will be invoiced upon completion or as agreed.
Any variations or additional charge-up works outside the original scope will be charged accordingly.
Where a client cancels or removes any portion of the agreed scope after acceptance, the Contractor reserves the right to charge reasonable administrative costs and loss of profit associated with the cancelled works.
Acceptance of a fixed price quote constitutes agreement of the full contact sum. Removal of scope after acceptance does not automatically reduce the contract price unless agreed in writing.
Price is fixed for quoted works however if more work is needed the client will be notified for approval. Accepting this quote you understand unforeseen scenarios can occur and are prepared for the chance of a variation. Examples of variations, finding asbestos, hidden leaks water or gas, power faults, harsh digging conditions due to roots & rocks, concrete slabs over 150mm thick, etc.
Customer must provide clear access to work areas. Additional charges may apply for delays or return visits caused by restricted access.
Our liability is limited to the value of works carried out.
All materials supplied remain the property of Bayside Plumbing & Gas Solutions until paid in full.
Material price increases outside our control may be passed on where applicable.
In the event of a cancellation a $100 dishonour fee will be charged to the client plus any handling fees passed on from suppliers for returns of materials or goods.
The Contractor shall not be liable for failure or delay in performance where such a delay arises from inclement weather, natural events, government restrictions, supply chain interruptions or other circumstances beyond reasonable control.
The Contractor is entitled to suspend works during unsafe or unsuitable weather conditions and to claim reasonable extension of time.
Suspension due to sickness or weather does not entitle the Client to cancel or reduce the contract sum.
Drain clearing services are performed on a best-effort basis. Payment is due if we're unable to clear.
Install temp hot water units as acceptance. Hire & labour costs remain payable regardless of cancellation.
The 10% Pensioner discount only applies to domestic residential customers only. To qualify, all permanent occupants of the property must be current pension card holders and not engaged in paid employment or receiving employment income at the time of service. The discount is not available to commercial properties, investment properties or rental properties where the pensioner is not the primary resident.
Where the client engages us at the direction of a third party (builder, property manager, etc.), the party requesting the work remains jointly and severally liable for payment.
Payment is due on the day of service unless otherwise agreed in writing. Accounts not paid by the due date may incur interest at a rate of 10% per annum, calculated daily on any overdue amount. The client agrees to pay any reasonable debt recovery costs, collection agency fees or legal expenses incurred in recovering outstanding amount.
Accepting this quote you've agreed to these terms. Xero contactless facilities for card payments are available, a 1.7% + 30c surcharge applies. Fee free payment can be made via internet bank transfer.
